How to Escalate a Complaint

  1. Call customer service first — 1-800-432-1000. Document the date, rep name, and case or reference number. For billing disputes, fee reversals, or account errors, ask specifically for a supervisor on the first call.
  2. Use online banking messaging for a written record — Log into bankofamerica.com or the BofA mobile app and use the secure message center. Written records via secure message are logged internally and are more likely to result in documented responses than phone calls.
  3. Visit your nearest financial center and request a manager — For branch-related issues, visit in person and ask for the Financial Center Manager. They have direct authority to resolve most local account, fee, and service issues on the spot.
  4. Request the Office of the President / Executive Customer Relations — When calling 1-800-432-1000, ask specifically to be transferred to the Executive Customer Relations team or Office of the President. Bank of America maintains a dedicated executive escalation process for unresolved complaints.
  5. Send a certified letter to HQ — Write to Bank of America Corporation, Office of the President, 100 North Tryon Street, Charlotte, NC 28255. Include your account number, prior contact dates and rep names, and the specific resolution you are requesting.
  6. File with the OCC — As a nationally chartered bank, Bank of America N.A. is regulated by the Office of the Comptroller of the Currency. File at helpwithmybank.gov. The OCC requires a formal investigation and response.
  7. File with the CFPB — The Consumer Financial Protection Bureau handles consumer banking complaints at consumerfinance.gov/complaint. CFPB filings require Bank of America to respond within 15 days. Bank of America is one of the most-complained-about banks in the CFPB database given its scale.
  8. File with the Federal Reserve — For complaints about state-chartered bank subsidiaries or holding company conduct, file with the Federal Reserve at federalreserve.gov/consumers/complaints.htm.
  9. File with the BBB — Bank of America is listed with the BBB in Charlotte, NC at bbb.org.

Executive Leadership

Brian T. Moynihan — Chair of the Board & CEO (CEO since January 2010; Chairman since October 2014)

Moynihan is one of the longest-serving CEOs of any major US bank. He joined Bank of America in 2004 through the FleetBoston Financial acquisition, where he had been General Counsel. He rose through the ranks leading Consumer & Small Business Banking, Global Wealth & Investment Management, and Global Banking before being named CEO in January 2010 — inheriting the bank at the height of its post-financial-crisis challenges, including $45 billion in federal bailout repayments and massive mortgage-related litigation. Under his 15-year tenure, he has repositioned the bank around “Responsible Growth,” paid down the TARP funds, and delivered consistent shareholder returns. In September 2025, he named two Co-Presidents as part of a transparent succession planning process, while publicly committing to remain CEO through the decade. He holds a BA from Brown University and a JD from Notre Dame Law School. Age 66. CEO email: brian.t.moynihan@bankofamerica.com.

Dean Athanasia — Co-President (since September 2025)

Athanasia leads Consumer Banking — Bank of America’s largest business segment by client count — overseeing retail banking across 3,700+ financial centers, small business banking, and consumer lending. He has been at Bank of America for over 30 years, holding leadership positions across consumer and wealth management before his elevation to Co-President. His promotion is widely viewed as placing him among the frontrunners to eventually succeed Moynihan.

Jim DeMare — Co-President (since September 2025)

DeMare leads Global Markets — the trading and sales division that delivered a record 15 consecutive quarters of year-over-year revenue growth through 2025. A 25+ year BofA veteran, he has built one of the strongest global equities and fixed income franchises on Wall Street. His elevation to Co-President alongside Athanasia sets up a visible internal succession race as Moynihan plans his eventual transition.

Alastair Borthwick — Executive Vice President & CFO (since September 2025)

Borthwick was elevated to EVP and continues as CFO following the September 2025 leadership restructuring. He oversees all financial reporting, treasury, tax, and investor relations, and serves as a strategic advisor to the management team. He joined Bank of America in 2005 and has served as CFO since 2021.

Lindsay Hans — President, Merrill Wealth Management

Oversees the Merrill Lynch wealth management franchise, including Merrill Financial Advisers across the US, serving clients with brokerage, investment, and financial planning services. Merrill is one of the largest retail brokerage platforms in the US by assets under management.
